TO: Honorable Town Board FROM: Jason Foote, Town Engineer DATE: May 28, 2026 SUBJECT: Town Engineer re Playground improvements at Harlem Road Park Requested Action: The Town of West Seneca intends to apply for a New York Plays grant for making playground improvements at the Harlem Road Park. We have reviewed the project regarding the State Environmental Quality Review (SEQR) process for the proposed playground improvements and we believe this work shall be considered as a Type II Action per the criteria set forth in 6NYCRR Part 617.5 (c) which constitutes: (2) “replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, unless such action meets or exceeds any of the thresholds in the section 617.4 of this Part;” Type II Actions are actions which have been determined to not have a significant effect on the environment and do not require Environmental Impact Statements or any other determination of procedure under the provisions of SEQR. Type II actions are exempt and not subject to review. Therefore, no further action is required for the project pertaining to the SEQR. However, it would be advisable for the Board to recognize, in a formal resolution, that the work is considered a Type II Action under SEQR. We have enclosed the following resolution for your use. Please do not hesitate to reach out to me with any questions or comments. RESOLUTION: Whereas, the Town of West Seneca Town Board (the “Board”) has considered the impacts to the environment for installing new playground equipment at the Harlem Road Park. Whereas, 6 NYCRR Section 617.5 (Title 6 of the New York Code of Rules and Regulations) under the State Environmental Quality Review Act (SEQR) provides that certain actions identified in the subdivision (c) of that section are not subject to environmental review under the Environmental Conservation Law.
