ZBA Mtg. #03 Regular Mtg. #03 April 21, 2026 Page 6

5. ZBA File #07-26, Tanya Bork, 6688 Powers Road, Zoned R-2, (Farm Lot 12, Township 9 Range 7, SBL # 185.09-
1-16). Requests an Area Variance to construct a 44 foot x 25 foot attached garage with a 6.2 foot side setback.
Minimum side setback for this R-2 lot is 10 feet, §144-9B Schedule of Height, Lot, Yard, and Bulk Regulations.
APPEARANCE: Jacquelyn Montemage, Bammel Architects, Applicant Representative
Ms. Montemage stated that her client wants to expand her garage to store a recreational vehicle. The current
  garage is existing, non-conforming.
The Board complimented Ms. Montemage on the diagrammed layout of the new garage she submitted; they
found it very helpful. It was established that the new structure was to be used only for vehicles, that no business
would be conducted, and that neighbors were notified (Ms. Montemage presented four letters of support, not
  previously received).
Mr. Mateer confirmed that the distance from the existing building to the property line was 9.17 feet at the street
  side.
The Chair then asked if there was anyone in the audience who would wish to speak in favor of the granting of
  the Variance.
  (Twice) NO RESPONSE
The Chair then asked if there was anyone in the audience who would wish to speak against the granting of the
  setback Variance.
  (Twice) NO RESPONSE
The Chair closed the Public Hearing.
The Chair then asked if the Secretary had received any additional communication either for, or against, granting
the Variance. The Secretary stated no additional communications had been received.
Mr. Mateer made a MOTION, seconded by Ms. Bowers, to APPROVE the AREA VARIANCE, based on the follow-
  ing:
  1. Per Section 144-63 (E) (1) All public notices have been filed.
  2. There will not be an undesirable change in the character of the neighborhood, or a detriment to nearby prop-
  erties created.
  3. The benefit sought cannot be achieved in another way, other than the granting of the Variance.
  4. The request is not substantial.
  5. There will not be an adverse effect or impact on the physical or environmental conditions of the neighbor-
  hood or district.
  6. The difficulty is self-created, however that does not preclude the granting of the Variance.
THE VOTE ON THE MOTION BEING:
  METZ AYE
  BOWERS AYE
  MATEER AYE
  RODO AYE
  WILLIAMS AYE
  The MOTION was UNANIMOUSLY APPROVED.
There being no further business to be presented to the Board at this time, the meeting was adjourned at 7:50
  P.M.
  DATED: 04/29/2026 Respectfully submitted,
APPROVED: 05/19/2026 Kristin B. Mahoney, Recording Secretary
