WHEREAS, the Town Board desires for the cost of such engineering services to be covered by National Energy Development, LLC, and has entered into an escrow agreement with said developer to cover such costs; and WHEREAS, the Town Board has received an Engineering Services Agreement for such engineering services from Wendel; and WHEREAS; the Town Board has reviewed the terms and conditions of said agreement, and finds such terms acceptable; and WHEREAS, the Town Board of the Town of Sardinia now desires to engage the services of Wendel, and shall authorize the Town Supervisor to execute an Engineering Services Agreement between Wendel and the Town of Sardinia. NOW ON MOTION OF which has been duly seconded by , be it RESOLVED, by the Town Board of the Town of Sardinia, that the Town Supervisor is hereby authorized to execute the Engineering Services Agreement with Wendel regarding the application for a special use permit for a Tier 3 Solar Energy System from National Energy Development, LLC, to be located at 10989 Savage Road in the Town of Sardinia.
