Supervisor Gingerich Jr. stated that the only thing that can be done now is to
approve the wording of the Bond for Stolle Road and Two Rod Road Solar
Projects as the Special Use permit requirements have not been met. The Solar
Company was notified on 12/22/25 as per the Special Use Permit that they
purchase materials from New York State and they showed them all out of
state and we found several items can be manufactured or purchased from a
business in Clarence, NY as our Engineers have researched and found. They
have not acknowledged it as of yet to make changes. I’m sure there are other
companies in New York State that make and sell the items they need. Until
that is corrected the Permit will be on hold. The Solar Company will have to
come up with a way to prove to the Town that the products are being made
and purchased in New York State. The Solar Company will have to submit
reports, receipts, etc. weekly or monthly to the Town Code Enforcement,
Town Clerk and Supervisor to prove where they have gotten the
equipment/parts in New York State. It is part of the requirements. The checks
will be released from escrow tomorrow; deposited and give it 14 days to
make sure they are valid checks and clear the bank.
The Town has updated and adopted the new Building Permit fees which
include fees for Personal and Commercial Solar Projects.
Motion: Councilman Reichert moved, seconded by Councilman Nolan to Accept the
wording for the Bond Issuance for the Stolle Road Solar Project.
Motion Carried.

Report of Town Officials
Building Inspector Scott Rider submitted a written report with 15 building applications received
with fees totaling $6,562, 15 building permits were issued with a total value of $723,900, 10
inspections and a total of 120 logged activities were made for the month of December. He also
submitted an annual report for 2025, 128 permits issued, fees totaling $36,451 and total value of
$5,371,850.
Assessor Chuck Mangarnro stated the early renewals have been mailed out.
Marilla Fire Company, Bill Blarr stated he will give a list of everyone that has not turned in their
paperwork for the payout as the Town has the check for those individuals.
Supervisor Gingerich Jr. stated the town is in the process of opening a new account for the previous
Service Awards program.
Erie County Sheriff Malican stated there were 108 calls of service in December, 13 accidents, 3
injuries with 1 fatality, 0 arrests, 0 robberies, 1 Burglary, 2 arrests (1 DWI & 1 Juvenile) . He will
be speaking with the department to increase patrols on Two Rod Road, Clinton Street and Three
Rod Road as that is where the current issues seem to be.
Open Board Presentations
Councilman Reichert stated they are working on the 250th anniversary of Celebration details. The
dates are July 3, 4 & 5, 2026. It will be a joint town event but will be held at the Marilla
Fireman’s grounds.
Councilman Nolan stated there have been some reports of speeding on Bullis Road and in the
afternoon into the evening there was a white van with 3 adult males going around to homes.
Erie Couty Sheriff Malican stated the department was made aware of it and dispatched a couple
deputies to the area.
Supervisor Gingerich Jr. stated the town does have a Solicitors Permit that is required in Marilla.
Supervisor Gingerich Jr. stated he met with Under Sheriff Colley and Chief Donavan on the
prospect of needing a full-time Deputy in the Town of Marilla. They may need to incorporate 4
full-time Deputies, currently have one for the town. They gave a cost breakdown for a full year,
it would be $622,658 and that would increase in 2027 and 2028. The reason the town looked into
was to find out for the security of the town due to the proposed Rooming House on Stolle Road.
The Planning Board will be having there meeting on Thusrday January 15, 2026 regarding the
Rooming House. The Planning Board does have the information regarding the full-time Deputies
salaries for the meeting. After meeting with the Sheriffs, they gave some concerns stating that
with only two Deputies for Elma, Marilla & Wales that when there are other events like football
games, etc. that they could possibly be pulled for these events and that would mean a longer
response time or not being able to respond if they are needed. Also, it is said that if the Rooming

House goes into the town the towns call volume will go up. The town has its hands full, and it is
our responsibility for security and to keep our residents safe.
Councilman Dolegowski stated he would like to do a Resolution for the Marilla Country Store in
March as they are celebrating there 175th Anniversary.
Motion: Councilman Reichert moved, seconded by Councilman Dolegowski to approve
the claims previously audited by the Town Board.
