August 12, 2026 WHEREAS, the Proposed Local Law and associated Energy Overlay District Map were classified as a Type I Action pursuant to SEQRA, and the Town Board initiated coordinated environmental review by circulating a Notice of Intent to Establish Lead Agency and supporting materials to identified involved and interested agencies on July 13, 2026; and WHEREAS, the applicable coordination period expired without objection to the Town Board serving as Lead Agency, and the Town Board thereafter served as Lead Agency for the SEQRA review of the Proposed Local Law; and WHEREAS, on August 12, 2026, before acting on the Proposed Local Law, the Town Board adopted Full Environmental Assessment Form Parts 2 and 3, determined that the Proposed Local Law would not result in any significant adverse environmental impacts, determined that preparation of an Environmental Impact Statement was not required, and issued a Negative Declaration of Environmental Significance pursuant to SEQRA; and WHEREAS, the Town Board has reviewed the Proposed Local Law, the proposed Energy Overlay District Map, the complete SEQRA record, available agency correspondence, the public hearing record, and all other materials and information presented to it; and WHEREAS, the Town Board finds that adoption of the Proposed Local Law is in the best interests of the Town of Eden and will promote the public health, safety, and welfare by updating the Town’s regulation of Solar Energy Systems while protecting agricultural resources, natural resources, scenic resources, community character, public infrastructure, emergency access, and the financial interests of the Town and its residents. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Eden hereby adopts Local Law No. 7 of 2026, entitled “A Local Law Repealing and Replacing Chapter 172 of the Code of the Town of Eden Entitled ‘Solar Energy Systems,’” in the form presented to and considered by the Town Board; and be it further RESOLVED, that the Energy Overlay District Map presented with and incorporated into the Proposed Local Law is hereby approved and adopted as part of Local Law No. 7 of 2026; and be it further RESOLVED, that the Town Clerk is hereby authorized and directed to: 1. Present the adopted Local Law to the Town Supervisor for approval in accordance with applicable law; 2. File the adopted Local Law with the New York State Secretary of State in accordance with the Municipal Home Rule Law; 3. Maintain the original Local Law, this Resolution, the Energy Overlay District Map, and the related SEQRA documents in the official records of the Town; 4. Cause the Local Law and associated zoning map amendment to be incorporated into the Code and official zoning records of the Town of Eden, as appropriate; and 29
