nonprofit activities. She does not want to put in an offer on the building until she knows if
that can be done. The Board believes that it is currently zoned as RAG, but Ms. Shaver
could get a special use permit to use the building for what she wants to. There was then
discussion on if she would be able to get a special user permit before she purchases the
building. Secretary Safford will ask Town Atty Attea if that is allowed, and she will speak
with Ms. Shaver after that conversation. Ms. Shaver is also going to check with the Lucy
Bensley Center to see if the building is listed as a historic property.

Comments from Council Liaison Drake

Council Member Drake told the Planning Board what happened at the last Town
Board meeting in regards to Frank Giordano’s special use permit. Mr. Giordano was
given until April 30, 2027 to fulfill the conditions of his permit. CEO Roberts mailed
Mr. Giordano a letter letting him know that if he does not meet all of the conditions of his
special use permit by April 30, 2027, his special use permit will be revoked. He had
previously spoken with CEO Roberts about waiting until spring to plant his small trees,
but is currently in the process of planting them

 Business from the Members

Acting Chairperson Zybert asked the Members if they had any business to
 discuss-

CEO Roberts let the Members know that there will probably be someone coming
to see the Board in regards to a new home occupation permit, and he added that he is
working on getting the bridge going to Kissing Bridge repaired. He has contacted
Kissing Bridge to let them know that a bridge inspector should come and look at the
bridge and advise on any repairs that should be made, and he is waiting to hear back from
 them.

  M. Cochran had some questions in regards to the annual Zoar Valley motorsport
event. The group has a special use permit that specifically says that there should not be
any races at the event, but the advertisement for the event this year said there was a race.
He thinks the event is great for the Mortons Corners fire department, but has concerns
about the fact that it is listed as a race. Secretary Safford will find the original special use
permit and bring it to a future meeting. CEO Roberts may need to reach out to the event
coordinator to remind them of the terms of the permit.

The Members then started to discuss the new Code updates. M. Cochran thinks that
before any new notes are made the Members should talk about the notes that are currently
in there, and delete what is taken care of. J. Zybert stated that several of the sections that
she was going over in the code book looked to have had the updates made to them
already. G. Marlette said that the code is not that disjointed right now, but there are areas
especially related to commercial property that need to be looked at and tightened up.
There should not be a lot of exemptions in the code. He is wondering if there is an
inventory of the non-conforming business signs that are allowed. It would be very
