e Special Use Permit - Open Development Area - Zachary Emer
Zachery and Amanda Emer - residing at 11732 North Canada Street are requesting approval
on an Open Development Area application in order to build a new residence. The lot is
currently zoned R2. The request is for a new lot with a non-conforming frontage to allow for
the construction of a single-family residence on the original lot that also has non-conforming
frontage. The property is 20.7 acres and has an existing non-conforming frontage of 132 feet.
The proposal is for a new lot with an existing home near the front of the property that will
remain with a non-conforming frontage of 97’6”. The existing lot will have a new non-
conforming frontage of 35’. The intent is to create a “shared use easement’ for the driveway to
continue further into the property, about 600 feet, yielding access to the location of a new
single-family home. The required paperwork was provided including an application for Open
Development Area, site plan, Erie County construction permit and approved plans for septic,
SEQR, and survey. They are projecting that the new home would be built next Spring.
After discussion, the Planning Board voted unanimously to recommend that the request for
Open Development Area be granted based on all information provided in the application and
the following conditions:
1) Per Justin Quant, Building Inspector, the existing unpermitted accessory building must
have the trusses removed, but must be demolished/removed prior to construction.
2) Driveway easement/shared maintenance must be included in final deed.
3) Marty completed SEQR Part 2 — Impact Assessment.
