NB: Meeting being recorded. Roll Call: Council: Muflahi, Anderson, Meegan (E) Surdyke, Marrano Dept. Heads: Law Department Communication from the Council – FOIL appeals from Lynette Sikorski 1. FOIL appeal regarding no response to August 10, 2026 request for formal certification of items 1‐6 “the City does not have possession of the records responsive to items 1‐6.” Moved by Marrano second by Muflahi to approve appeal; request City Clerk to send letter using the word “certified”. Yeas: Muflahi, Anderson, Surdyke, Marrano Carried 4‐0 2. FOIL appeal regarding item 8 – not provided with a record identifying a specific calendar date on which the 45‐day referendum period expires. Moved by Marrano second by Anderson to deny appeal of item 8 ‐ there is no City record that specifically identifies a calendar date that the 45‐day period expires. Yeas: Muflahi, Anderson, Surdyke, Marrano Carried 4‐0 3.FOIL appeal regarding item 9 – records requested are exempt under Public Officers Law §87(2)(c). Moved by Marrano second by Anderson to deny appeal request ‐ disclosure of communications would be detrimental to the negotiations between the City and Erie County.
