TO: Honorable Town Board FROM: Chris Trapp, Town Attorney DATE: March 23, 2026 SUBJECT: Town Attorney re Local Law 2026-5 Modification of Chapter 28-2A Alternate Planning Board and Zoning Board of Appeals Members Requested Action: In the effort to prevent cancellation of meetings or the rescheduling of matters before the Planning Board and/or Zoning Board of Appeals, a local law is being proposed which will allow the Town Board to appoint alternates to the respective boards in the event of a conflict of interest or simply an absence due to something such as an illness or work commitment. While the Town Law provides for such a grant for a conflict of interest, in order to allow for appointments due to an absence, Municipal Home Rule section 22 must be used.
