Re. Contract Between the City of Lackawanna and LaBella Associates.

Dear Council President Marrano and the Honorable City Council:

I am requesting that the enclosed proposed agreement between the City of Lackawanna and
LaBella Associates (“LaBella”) be placed on the agenda for City Council approval on July 20, 2026
authorizing Mayor Iafallo to sign same.

At the City Council meeting on June 22, 2026, Your Honorable Body approved retaining LaBella
to assist the City with preparation and submission of an application for Round 10 of the NYS Downtown
Revitalization Initiative. The corresponding contract incorporates LaBella’s proposal for the work and
includes LaBella’s terms and conditions, which appear to be standard. The agreement also includes an
indemnification provision in favor of the City.

Thank you for your consideration of this request.

ARIANNA KWIATKOWSKI, CITY ATTORNEY

Moved by Marrano second by Surdyke to approve agreement and have Mayor sign same.
