Re: Resolution Authorizing the City of Lackawanna to Negotiate an Agreement for
  Assessment Services with Erie County.

Dear Council President Marrano and Honorable City Council:

At the upcoming Special Meeting on July 7, I am requesting that the City Council vote to act on
the enclosed resolution authorizing the City of Lackawanna (via Mayor Iafallo and/or her designee) to
enter into negotiations relative to an eventual contract with Erie County for the provision of assessment
services.
Such an arrangement is specifically contemplated by Section 1537 of the New York Real Property
Tax Law. Under Section 1537, the City Council must vote via resolution to permit the City to enter into
negotiations relative to the agreement. The Council must then wait 45 days before voting to authorize
Mayor Iafallo to execute an eventual agreement to allow for a permissive referendum.
The benefits of pursing an agreement with the County, among others, is that Michael Milks would
continue to remain our appointed assessor for the remainder of his term, and the County would be
entirely financially responsible for conducting reassessments on a cyclical basis.
Both myself and Assessor Milks will be present at the Special Meeting to address any questions
your Honorable Body may have.
Thank you for your consideration of this request.

ARIANNA KWIATKOWSKI, CITY ATTORNEY

Moved by Marrano seconded by Anderson to receive and file, act on resolution.
