  MEMO

TO: Mayor Wochensky and Village Trustees

FROM: Richard Miga, Assistant Code Enforcement Officer

DATE: May 13, 2026

The Building Department has received and reviewed a Special Use Permit (SUP) application for
The Bank at EA, at 649 Main St. by Peter Sorgi, project attorney for the new property owner
Carner Development. The property currently is operating under the approved development plan
and SUP applications, of which for the wedding and event venue, SUP approvals dated 2/10/21
and amended on 4/5/21 (meeting minutes and permit attached). The SUP application is not
changing the existing development plan or SUP approvals but is requesting to provide restaurant
services when the venue is not booked for weddings or events with the following hours of
operations of 11am through 10pm every day; however at the commencement of the restaurant,
the proposed hours will be Sunday 11am-3pm; Monday through Thursday 4pm-9pm; and Friday
through Saturday 4 pm – 10pm. During hours of operations the number of employees will be 60
with approximately 15 at any given time, a maximum indoor seating of 230 occupants (180
occupants on the first floor and 50 occupants on the second floor), and outdoor seating
(courtyard, walkway areas, and front of building) of 120 occupants. The SUP application also
noted low volume outdoor music.

Village Code section 285-50.4C requires the Village to submit the applications to Erie County
Department of Environment and Planning for their review and comment due to proximity to a
State highway.

Village Code section 285-52.3B states that the Village Board may refer the Special Use permit
application to the Planning Commission for their review and recommendation. The Village
Board shall then schedule a public hearing for the application.

This is an Unlisted action for purposes of SEQR.
