Resolution to adopt tax levy override WHEREAS, a public hearing was held on September 28, 2026, for discussion and public comment concerning adoption of proposed local law #15, 2026 WHEREAS, proposed local law #15, 2026, is a local law to override the tax levy limit established in General Municipal Law Section 3-c, NOW THEREFORE BE IT RESOLVED that the Hamburg Town Board adopt this proposed local law to read as follows: Local Law No. 15 of the year 2026 Town of Hamburg, State of New York A local law to override the tax levy limit established in General Municipal Law §3-c, Be it enacted by the Town Board of the Town of Hamburg as follows: Section 1. Legislative Intent It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Hamburg pursuant to General Municipal Law §3-c, and to allow the Town of Hamburg to adopt a budget for the fiscal year 2027 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law §3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of the General Municipal Law §3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal 140
