Town Board of the Town of Hamburg September 28, 2026 Meeting 4.16. Moratorium on Large-Scale Data Centers WHEREAS, the rapid development of large-scale data centers and artificial intelligence computing facilities presents significant land-use and infrastructure considerations, including electrical and water demands, noise, backup power generation, environmental impacts, and compatibility with surrounding properties; and WHEREAS, although the Town of Hamburg currently regulates artificial intelligence data centers under its zoning laws, the Town Board wishes to further review those regulations in light of the rapidly evolving nature and scale of these facilities; WHEREAS, a one-year pause in the approval and development of new large-scale data centers would provide the Town with an opportunity to study these issues and determine whether additional regulations are necessary to protect Town residents, infrastructure, natural resources, and neighboring properties; WHEREAS, the Town of Hamburg Planning Department will complete filing requirements with Erie County Department of Planning. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Hamburg hereby directs the Town Attorney and appropriate Town departments to prepare a proposed Local Law establishing a one-year moratorium on the approval and development of new large-scale data centers within the Town of Hamburg, during which time the Town shall review its existing zoning and land-use regulations applicable to such facilities; and BE IT FURTHER RESOLVED, that the Town’s review shall include consideration of electrical and water demands, noise, environmental impacts, emergency and backup power systems, infrastructure capacity, and compatibility with surrounding land uses; and BE IT FURTHER RESOLVED, that a public hearing upon the proposed Local Law shall be held on November 2, 2026, at 6:00 p.m., at Hamburg Town Hall, 6100 South Park Avenue, Hamburg, New York, and that the Town Clerk is hereby authorized and directed to provide notice of such public hearing as required by law. 28
