Town Board of the Town of Hamburg September 14, 2026 Meeting 4.29. Opposition to Creation of an Erie County Planning Board or Commission WHEREAS, Erie County Legislator Jeanne Vinal, representing portions of the Towns of Amherst and Cheektowaga, has recently contacted local officials regarding a renewed effort to reinstate the Erie County Planning Board; and WHEREAS, proposals of this nature have been opposed and rejected numerous times over the past two decades; and WHEREAS, based on the version of a draft local law shared and referenced by Legislator Vinal’s communication, this Planning Board would derive its mission and purpose from a regional growth plan adopted by Erie County in 2007; and WHEREAS, under this version of the law, only two of the nine voting members of this board would reside outside of the Cities of Buffalo, Lackawanna, and Tonawanda or the Towns of Amherst, Cheektowaga, Tonawanda, and West Seneca, leaving a large representation gap for communities that make up a majority of the land area of Erie County, and making no distinction between suburban and rural communities outside of first-ring suburbs; and WHEREAS, according to New York State Law, this board could have authority to review and reject certain local project proposals, or set conditions for the approval thereof, as well as act as lead agency under the State Environmental Quality Review Act, stripping away local control of the environmental impact review process; and WHEREAS, creation of such a board would add an additional and unnecessary layer of bureaucracy to the already daunting task of fostering constructive economic development within our region; and WHEREAS, the oversight and control conferred upon such a board would reduce the voice of local governments and the residents who would make decisions regarding land use within their own communities; and WHEREAS, local municipalities and the residents who elect their government officials deserve to retain autonomy and authority to determine their own development and zoning plans that best suit their communities; and 43

Page 44

WHEREAS, the State of New York has already been encroaching upon local control by proposing and enacting legislation that allows them to override local zoning regulations for various types of projects; and WHEREAS, the Hamburg Town Board desires to maintain the identity of our community and retain control over its vision for growth through local representation; and WHEREAS, the Hamburg Town Board does not believe the establishment of an Erie County Planning Board would be in the best interests of the residents of the Town of Hamburg or similarly situated municipalities across Erie County. NOW, THEREFORE BE IT RESOLVED, that the Hamburg Town Board believes it is crucial that local municipalities retain the right to determine their own planning actions; and be it further RESOLVED, that the Hamburg Town Board hereby opposes the creation of an Erie County Planning Board; and be it further RESOLVED, that the Town Clerk shall send certified copies of this resolution to Erie County Executive Mark Poloncarz, members of the Erie County Legislature, and the Association of Erie County Governments. 44

WHEREAS, a copy of the Amended Report has been filed with the Town Clerk’s Office for public inspection; and WHEREAS, the Town Board has reviewed the Amended Report, and desires to notice and hold a public hearing regarding the formation of the Town Drainage and Stormwater Management District pursuant to Article 12-A, Section 209-d of the Town Law; and WHEREAS, this Resolution shall supersede the previously adopted Resolution calling for a public hearing on the establishment of the proposed District. NOW, THEREFORE, THE BOARD DOES HEREBY RESOLVE AND ORDER, that the Town Board will hold a public hearing pursuant to Article 12-A, Section 209-d of the N.Y. Town Law on the 28th day of September 2026 starting at 6:00 p.m. at the Hamburg Town Hall, on the establishment of the proposed District, and at which all interested persons may be heard (the “Public Hearing”). IT IS FURTHER RESOLVED AND ORDERED, that pertaining to the proposed Town Drainage and Stormwater Management District, the Town Board does hereby find as follows: 1. The boundaries of the proposed District encompass all parcels within the Town (excluding the parcels in the Villages of Hamburg and Blasdell), as all areas are serviced by the storm sewers, drainage channels, and other stormwater features of the overall system. A map of the proposed boundaries of the District is included in the Amended Report, and such map is incorporated herein at Appendix A; and 2. The Town anticipates undertaking the following capital improvements and projects which shall be funded through the proposed District: (a) updating the GIS mapping of the stormwater and drainage system to address missing and incorrect data; (b) redirecting road drainage from a private pond to the Town system at Winding Woods Lane and Lewis Drive; (c) installing drainage swale in Tomaka Park; (d) replacing the 3’x8’ concrete culvert across Lynwood Avenue; (e) replacing the culvert headwall at Roseview Avenue; (f) replacing the culverts along the Town-owned portion of Bayview Road including the 18” culvert between Beetow Drive and Twilight Lane and the 24” culvert near Rosetta Road; (g) replacing the 30” culvert and 2’x2’ box culvert across Old Lakeview Road near Lakeview Road; (h) replacing the crushed inlet of the 12” culvert on Schoellkopf Road near Old Lake Shore Road; and (i) replacing corrugated metal pipe (CMP) storm sewers in multiple areas of the Town due to aging, deterioration, rust, collapse, and/or capacity issues due to size. 49

3. The Town has determined that the establishment of a reserve fund for the proposed District is necessary for financial security and function, and the annual cost of the reserve fund is estimated to be $130,000. 4. The estimated total annual cost of the proposed District is $1,621,200 as shown below: 5. The revenues required to meet the annual costs of the proposed District would be recovered through a benefit fee, which would be assessed on an Equivalent Dwelling Unit (“EDU”) basis, as more fully explained in the Amended Map, Plan and Report. 6. Based on the total number of EDUs and the anticipated total annual costs associated with the District, including capital needs, the Town is proposing a fee of $64.65 per EDU. A single-family household would be assessed at one EDU annually, and therefore the annual cost to the typical property in the first year of the District is $64.65. 7. The proposed District contains commercial properties and certain properties categorized as Multiple Residence, Apartment, or Rural Residential. These types of properties shall be assessed based on the total impervious area of the parcel divided by 1,000 square feet to determine an equivalent number of EDUs. A list of the properties that are categorized as Multiple Residence, Apartment, or Rural Residential (including the EDU assigned to each specific property) is contained in Appendix C of the Amended Report. A list of commercial properties (including the EDU assigned to each specific property) is contained in Appendix D of the Amended Report. 8. The Amended Report describes the proposed improvements, financing and estimated annual costs of the proposed Town Drainage and Stormwater Management District and is available for public inspection in the Town Clerk’s Office. IT IS FURTHER RESOLVED AND ORDERED, that the previously adopted Resolution, dated August 10, 2026, calling for a public hearing on the establishment of the District, is withdrawn; and IT IS FURTHER RESOLVED AND ORDERED, that the Town Clerk is hereby authorized and directed to publish a copy of this Order in the Town’s official newspaper and to post a copy of the same on the official bulletin board for the Town in the time and manner required by the Town Law, and enter same in the minutes of the proceedings of the Town Board; and 50
