March 23, 2026 Meeting
4.13. Amended LWRP Rezonings SEQR and Adoption Resolution (Camp Road and St. Francis Drive)

WHEREAS, the Town of Hamburg has completed a draft amendment of the Town’s Local Waterfront
Revitalization Program (LWRP) and is proceeding towards adoption; and

WHEREAS, the New York State Department of State (NYSDOS) has recommended that the Town
adopt amendments to the Zoning Map as outlined in Section V of the draft LWRP, prior to adopting the
LWRP amendment; and

WHEREAS, pursuant to Municipal Home Rule Law, the Town Board is proposing to enact a local law
which proposes to amend the Town’s Zoning Map as follows:

Be it enacted by the Town Board of the Town of Hamburg, New York, that the Hamburg Town Board
amends the Town Zoning map as follows (as illustrated on the attached maps):

Rezone SBL #: 159.18-3-24 from C-3 (Office District) to NC (Neighborhood Commercial
  General Residence District)
  Rezone SBL #s: 159.18-3-25, 159.18-3-22, 159.18-3-21, 159.18-3-19, 159.18-3-18, and 159.18-
3-17 from C-3 (Office District) to R-3 (Multifamily Residence District); and

WHEREAS, amendments were made to rezone SBL #s: (159.18-3-25, 159.18-3-22, 159.18-3-21,
159.18-3-19, 159.18-3-18, and 159.18-3-17) which are homes along St. Francis Drive from C-3 to R-3
instead of R-1, due to some property owners having two-family dwellings on their parcel, which are not
allowed in R-1, but are allowed in R-3, as well as matching the existing R-3 zoning in Athol Springs to
the north; and

WHEREAS, an amendment was made to rezone SBL #: 159.18-3-24 to NC which is currently vacant,
to allow for the flexibility of a single-family home or a low-intensity commercial use that meets the
existing neighborhood character; and

WHEREAS, a public hearing was held regarding these zoning map amendments on January 26, 2026,
and comments were received and acknowledged from the public; and

WHEREAS, the required § 239-m County Referral was completed and no objections were received;
