Town Board of the Town of Hamburg January 26, 2026 Meeting 4.3. Schedule Article LX Smoke Shops and Vape Shops Public Hearing WHEREAS, the Hamburg Town Code contains and specifies the local laws and ordinances of the Town of Hamburg; and WHEREAS, the Town has received complaints from residents regarding smoke shops and vape shops; and WHEREAS, the Code Review Committee has generated a draft for smoke shops and vape shops regulations, and has sent these suggested revisions for the Town Board to begin the adoption process; and WHEREAS, pursuant to Municipal Home Rule Law, the Town Board is proposing to enact a local law as follows: Be it enacted by the Town Board of the Town of Hamburg, New York, that the Hamburg Town Board proposes to amend the Hamburg Town Code as follows (full copies attached): Add a new “Article LX Smoke Shops and Vape Shops” to Chapter 280 WHEREAS, the Hamburg Town Board referred this proposed law amendment to Erie County through the 239-m referral process and received no objections, NOW, THEREFORE BE IT RESOLVED, the Hamburg Town Board hereby sets a public hearing on this proposed local law amendment for February 23rd, 2026, at 7 pm in the Court Room of Hamburg Town Hall.
