TO: Honorable Town Board FROM: Jason Foote, Town Engineer DATE: July 13, 2026 SUBJECT: Town Engineer re WQIP Grant Resolution Requested Action: The Town of West Seneca is planning to submit a WQIP application to NYS Department of Environmental Conservation (NYS DEC) for the Phase 10 and Orchard Park Road Sanitary Sewer Improvement project by the July 27, 2026 deadline. The total project is estimated to be $11,304,000, as shown on the attached cost estimate. If successful, the WQIP grant would cover 75% of the project costs, however, we will not know until later this year or early next year if the Town is successful in receiving a grant. The Phase 10 and Orchard Park Road Sanitary Sewer Improvements work is being completed as part of the compliance with the Town’s Consent Order for eliminating sanitary sewer overflows (SSO). 1. Authorizing Resolution: As part of the WQIP application process, NYS DEC requires the municipality pass a resolution outlining the total project cost, expected grant amount, and the remaining Town funded portion. Therefore, we are requesting the Town Board pass the following resolution which includes all of the required information. Please note the adoption of this resolution does not fully commit the Town to completing the project, it only authorizes the Town to proceed with the WQIP grant application. A final decision on whether the Town wishes to proceed can be made once it is known if the Town is successful in receiving a WQIP grant. A certified copy of the resolutions will be sent to NYS DEC along with other required documents as part of the WIIA grant application. 2. SEQR Resolution: We have reviewed the State Environmental Quality Review (SEQR) for replacement of the proposed project. We believe this work shall be considered as a Type II Action per the criteria set forth in 6NYCRR Part 617.5 (c) which constitutes: (2) “replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, unless such action meets or exceeds any of the thresholds in the section 617.4 of this Part;” Page 87 of 210
