Type II Actions are actions which have been determined to not have a
significant effect on the environment and do not require Environmental
Impact Statements or any other determination of procedure under the
provisions of SEQR. Type II actions are exempt and not subject to
review. Therefore, no further action is required for the project
  pertaining to the SEQR.

However, it would be advisable for the Board to recognize, in a formal
resolution, that the work is considered a Type II Action under SEQR.
We have enclosed a suggested resolution for your use.

RESOLUTION: WHEREAS, the Town of West Seneca, after thorough consideration of
the various aspects of the problem and review of available data, has
hereby determined that certain work, as described in its Phase 10 &
Orchard Park Road Sanitary Sewer Improvements certified
engineering report, to address the repair and maintenance of the
Town's Sanitary Sewer System, herein called the “Project”, is
desirable, is in the public interest, and is required in order to implement
the Project and address said compliance
  requirements; and

WHEREAS, the New York State Department of Environmental
Conservation (NYSDEC) authorizes State assistance to municipalities
for water quality improvement projects by means of a contract, and the
Town of West Seneca deems it to be in the public interest and benefit
to enter into a contract therewith.

NOW, THEREFORE, BE IT RESOLVED BY the West Seneca Town
  Board, that:

  1. Supervisor Gary Dickson, or his representative or successor in
office, is the representative authorized to act on behalf of the West
Seneca Town Board in all matters related to State assistance under
