The one certified copy of this Resolution be prepared and will accompany the 2026 WQIP grant application; and 5. This Resolution takes effect immediately. SEQR TYPE II DETERMINATION Whereas, 6 NYCRR Section 617.5 (Title 6 of the New York Code of Rules and Regulations) under the State Environmental Quality Review Act (SEQR) provides that certain actions identified in the subdivision (c) of that section are not subject to environmental review under the Environmental Conservation Law. Resolved, that the Town of West Seneca herby determines that the proposed Phase 10 and Orchard Park Road Sanitary Sewer Improvements is a Type II action in accordance with the following: NYCRR Section 617.5 (c) which constitutes the: (2) replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, unless such action meets or exceeds any of the thresholds in the section 617.4 of this Part;" And is therefore not subject to further review under 6 NYCRR Part 617.
