Compliance and Enforcement
The Applicant and any operator of the Approved Premises shall comply with the approved uses, Approved
Plan, all conditions of this permit and the approving Village Board resolution, and all applicable provisions
  of law.
The permit authorizes only the uses and activities expressly stated. No additional activity will be deemed
authorized as incidental to an approved use unless expressly approved by the Village Board and
incorporated into an amended permit where required.
Any change in ownership of the Property, the Applicant, or the user or entity granted this permit will require
Village Board review and issuance of a new permit pursuant to §285-52.1(C).

Failure to comply with any permit condition may result in enforcement under applicable law, including
consideration of revocation by the Village Board pursuant to §285-52.6, following any required notice and
opportunity to be heard. Nothing in this paragraph limits immediate termination of an event due to a
violation of the Noise/Amplified Sound condition.
Seconded by Trustee Bojanowski and unanimously approved.
o Mayor Wochensky reviewed some of the restrictions and requirements. He feels like this is a
nice combination of what the residents want and the business. He responded to the question of
enforcement and balance. He thanked Trustee Kamp and Village Administrator Tufte for their
work on the agreement. Trustee Root thanked the business owner for working with the Village
Board and listening to the residents’ concerns. Trustee Kamp reiterated what Mayor Wochensky
stated about the collaboration. Mayor Wochensky and Trustee Kamp want feedback from the
residents but also for them to address concerns with the business owners as well. Trustee
Lazickas noted the three-month review and spoke about the process of a callback. Trustee
Bojanowski said it was a well-thought-out process. Trustee Kamp said that it was the first new
business to come to this Village Board. Mayor Wochensky thanked the residents for their
  comments.
• A motion by Trustee Lazickas to Award the auction amounts from Auctions International for a 2020
Ford Explorer Police VIN 96106 to EliasTorres2788 in the amount of $7,700.00, seconded by Trustee
  Root and unanimously approved.
• A motion by Trustee Bojanowski to approve the Village of East Aurora’s resolution to participate in the
  NY Helps program as written:
  HELPS PROGRAM
Whereas, the Village of East Aurora board of Trustees has the authority to manage the Village Personnel
efficiently and effectively in accordance with applicable laws, rules, regulations, and collective
bargaining agreements, including New York State Civil Service Laws and the Erie County Rules for the
  Classified Service; and
Whereas, the New York State Civil Service Commission has developed and the Erie County Personnel
Department has adopted the NYS HELPS (Hiring for Emergency Limited Placement Statewide)
program, which allows for the inclusion of titles where qualified individuals may be appointed to a non-
competitive version of a competitive title in order to gain permanent status without competitive
examination and, upon completion of a necessary probationary term, be placed in the competitive class
  without further exam; and
Whereas, Erie County has recommended that the below resolve clause regarding the appointment
process be approved to allow the Village of East Aurora to appropriately utilize the NYS Helps program
in its most efficient form so as not to delay the ability of employees hired through the program to gain
  permanent status.
Now therefore be it resolved, that any individual appointed by this honorable body prior to or going
forward which is afforded the opportunity to utilize the NYS Helps program, as approved and
administered by The County of Erie, shall be, without further approval of this body, appropriately placed
