TO: Honorable Town Board FROM: Kate Newton, Town Clerk DATE: January 26, 2026 SUBJECT: Town Clerk Newton re Proofs of Publication and posting of legal notice "OF A PUBLIC HEARING TO HEAR ALL PERSONS INTERESTED IN THE PROPOSED REZONE REQUEST FOR 120 SOUTH AVE, CHANGING ITS CLASSIFICATION FROM C-1&R-50 TO C-2 " in the Town of West Seneca. Publication date was December 25, 2025. Requested Action: This request was reviewed by the Planning Board at the December 11, 2025 meeting. The parcel has a zoning classification of C-1 to a depth of approx 200ft, then transitions to R-50 for the remainder of the site. The initial request was made to rezone the entire parcel to C-1 to permit additional warehouse buildings at the site. The Planning Board recommended the entire site be rezoned to C-2, to conform to the Town Zoning Code. The motion at the Planning Board passed 7-0. If this request is approved, it would return to the Planning Board for a Final Site Plan Approval. You are required to make a determination pursuant to SEQRA, see attached draft resolution by the Town Attorney. An additional vote must then be taken for the rezone of the property.
