5. Documentation: Whenever any contract is awarded on the basis of best value instead of lowest responsible bidder, the basis for determining best value shall be thoroughly and accurately documented. 6. Procurement policy superseded where inconsistent: Any inconsistent provision of the Town's Procurement Policy, as adopted prior to the effective date of this chapter by resolution of the Town Board of the Town of Boston, or as amended thereafter, shall be deemed superseded by the provisions of this chapter. Guideline 5: Prevailing Wage Review for Maintenance and Service Contracts: In accordance with Articles 8 and 9 of the New York State Labor Law, the Town shall evaluate all contracts for services, maintenance, repair, installation, or alteration of municipal buildings, facilities, infrastructure, or building systems to determine whether prevailing wage requirements apply. Particular consideration shall be given to contracts involving the maintenance, repair, or replacement of building systems including but not limited to heating, ventilation, and air conditioning systems, plumbing systems, electrical systems, elevators, fire protection systems, and similar mechanical or structural components. Where such work may constitute public work or building service work under the Labor Law, the Town shall include the appropriate prevailing wage schedules issued by the New York State Department of Labor in the bid specifications or contract documents and require contractors to comply with all applicable wage, supplement, and reporting requirements. Departments initiating procurement shall consult with the Town Supervisor, Town Bookkeeper, or Town Attorney when there is uncertainty regarding the applicability of prevailing wage requirements. Contractors performing public work shall be required to submit certified payroll records and comply with all reporting requirements required under New York State Labor Law. The Town reserves the right to require compliance with prevailing wage requirements where the scope of work reasonably involves construction trades or maintenance of building systems, even if the applicability of prevailing wage requirements is uncertain at the time of procurement. Guideline 6: Inability to Obtain Proposals A good-faith effort shall be made to obtain the required number of proposals or quotations. If the Purchaser is unable to obtain the required number of proposals or quotations, the Purchaser shall document the attempt made at obtaining the proposals. In no event shall the inability to obtain the proposals or quotes be a bar to the procurement. Page 3 of 5
