UNCOMPLETED WORK AGREEMENT CONTRACT: D040611 COUNTY: Erie This Agreement made by and between The Town of Aurora, hereinafter referred to as the "Town," acting by and through the Town of Aurora Supervisor, hereinafter referred to as "Supervisor," under the provisions of the Highway law, Section 38 (7)(c) and Oakgrove Construction 6900 Seneca St., P.O. Box 103 Elma, NY 14059 (1) a corporation organized and existing under the laws of the State of New York (2) a limited liability company (LLC), organized under the laws of the State of (3) a partnership consisting of (4) an individual conducting business as hereinafter called “Contractor,” as follows: WHEREAS, the Supervisor who is in charge of the above-identified contract for and on behalf of the Town has certified that the essential items in the contract of the said project have been completed in accordance with the terms of the said contract and the provisions of the Highway Law, and NOW, THEREFORE, in consideration of the mutual covenants and agreements between the parties hereto.
