VILLAGE OF EAST AURORA LOCAL LAW NO. ___ OF THE YEAR 2026 A LOCAL LAW AMENDING CHAPTER 180 OF THE CODE OF THE VILLAGE OF EAST AURORA, ENTITLED "PEDDLERS AND SOLICITORS," BY ADDING A NEW ARTICLE IV, ENTITLED "AGGRESSIVE SOLICITATION" Be it enacted by the Board of Trustees of the Village of East Aurora as follows: Section 1. Authority. This local law is enacted pursuant to the Municipal Home Rule Law of the State of New York and the police powers of the Village of East Aurora to protect and promote the health, safety and general welfare of the residents, businesses, and visitors of the Village. Section 2. Legislative findings and purpose. The Board of Trustees finds that the Village of East Aurora is a vibrant community with commercial establishments, restaurants, retail businesses and other destinations regularly patronized by residents and visitors. The Board further finds that persons patronizing businesses and other establishments should be able to enter and exit such establishments, walk through parking areas and sidewalks, and enter and exit their vehicles without being subjected to threatening, intimidating, coercive, persistent, physically intrusive, or obstructive conduct associated with solicitation. The purpose of this local law is to prohibit specific conduct associated with solicitation that is threatening, intimidating, coercive, physically intrusive, obstructive or otherwise likely to interfere with a person's safe and free movement or ability to use and enjoy public places and areas open to the public. The Board further finds that aggressive solicitation may cause residents and visitors to avoid businesses and other establishments, may interfere with the free flow of pedestrian and vehicular traffic, and may create an unsafe or intimidating environment for persons patronizing businesses or traveling through the Village. Accordingly, the purpose of this article is to protect persons from aggressive conduct associated with solicitation while preserving lawful and peaceful solicitation and other protected expressive activity. Section 3. Amendment.
