He said that he saw Code Enforcement Cassidy and she said to shut it down now, then he said
that he saw a friend and got a drink before shutting the music down 20 minutes later at 9:20pm.
He said that no one was on the premises at 10pm. Mayor Wochensky said that he was informed
that further intervention by the Police Lieutenant was needed after the Code Enforcement asked
him to shut down. Mr. Amabile said that they had already started shutting down and that he was
planning on having everyone out by 10pm. Mayor Wochensky asked again if Mr. Amabile was
aware that he was a part of the Heart of Music Festival and that the end time was 10pm. Mr.
Amabile said that he was aware and that no one was in his parking lot after 10pm. Mayor
Wochensky asked if there was music going after 9pm and if he was aware that the protocol said
that the music had to be done by 9pm. Mr. Amabile said that he was aware of the 9pm protocol
and that he had music until 9:20pm. Mayor Wochensky said that there was further violations
during the July 3rd parade at Riley Street. Mr. Amabile said that his restaurant has never been
closed on July 3rd. Mayor Wochensky said that the issue here is that Riley Street was serving
food, Mr. Amabile said that they were not. Mayor Wochensky said that they had a hot dog stand
with a tent, food serving trays, grill and was serving hot dogs at the sidewalk. Mr. Amabile said
that he was providing the community with hot dogs, snacks and water for free. Mayor
Wochensky asked about the DJ outside and asked if he has a DJ outside every Friday night, Mr.
Amabile said no. Mayor Wochensky asked if he had proper authorization to have a DJ outside
and sell food, Mr. Amabile said that he didn’t do anything wrong and was just providing for the
community. Mayor Wochensky said that a temporary use permit would be required for the food
and the music and said that it’s important for public safety that the businesses follow the rules.
Police Chief Welch said that we have so many restaurants and so many bars in this village that
don't have issues that if they have a question, they reach out and plan ahead of time. He said that
he and Code Enforcement Officer Cassidy were involved in both instances and there were
intentions to violate the permit. Mayor Wochensky asked how long between when he was
informed to shut down and when he actually shut down. Mr. Amabile claims that it was shut
down before the parade went on. Mr. Amabile said that on his special use permit it says that he
can only have one or two musicians with acoustics on the patio and that he wasn’t aware of that
and has been having more than two musicians. Clerk-Treasurer Jerackas said that he needs to
  amend his special use permit.

  • Heart of Music Follow-Up – Chris Welch
o Mr. Welch said that the Jett’s Bagel issue was 100 percent his fault; he said that he thought that
they were a tent and not a food truck. Clerk- Treasurer Jerackas said that they would have to
have been on the permit whether they were a tent or a food truck, but they were not on the permit
at all. Mayor Wochensky said that he is going to review the Village resources given to the event.
Mr. Welch said that this event is one of the most profitable uses of the Village resources for the
small businesses here and that those businesses pay taxes for the resources being used. Trustee
Kamp asked Mr. Welch what his profit was for this year’s event. Mr. Welch said that they will
be donating everything. Trustee Kamp asked Mr. Welch where they donate the money to, Mr.
Welch said that they will be announcing that on July 29th at the rink. Mayor Wochensky asked if
any reports were submitted to the Village Board after the event or if they have ever been audited.
Mr. Welch said that they have never been audited and all of their tax returns are public record.
Mayor Wochensky said that he agrees that it is a positive benefit for businesses but needs to get
an understanding of what the full costs to the taxpayers is.
