TOWN OF CONCORD SPECIAL TOWN BOARD MEETING
FEBRUARY 18, 2026 8:15 a.m.

MEETING CALLED TO ORDER BY PHILIP DROZD, SUPERVISOR,
at 8:15 a.m.

ROLL CALL: PHILIP DROZD, SUPERVISOR
  CLYDE M. DRAKE, COUNCIL MEMBER
  KENNETH D. ZITTEL, COUNCIL MEMBER
  KIMBERLY S. KRZEMIEN, COUNCIL MEMBER
  KENNETH KASSEL, COUNCIL MEMBER

ALSO PRESENT: LAURA SAFFORD, TOWN CLERK
  LARRY HEIM, HIGHWAY SUPERINTENDENT

Supervisor Drozd opened the Special Town Board Meeting at 8:15 A.M.

SPECIAL USE PERMIT, FRANK GIORDANO, 11998 TREVETT RD.

Council Member Zittel wanted to discuss where the culvert is positioned. He has
received some phone calls about it, and some letters received in the Town Clerk’s office
from some of the neighbors commented about the traffic on that road. Council Member
Zittle stated that he would like to see the culvert removed and have the entrance be at a
different area. Supervisor Drozd replied that he doesn’t think that the Board has the
authority to request that, even with the Special Use Permit, because it is a County road.
That would be a question for Town Attorney Attea. Council Member Zittel commented
that Mr. Hoffman was correct in what he said at the Public Hearing meeting-residents
seem to be better off doing what they want and then asking for forgiveness afterwards.
Supervisor Drozd stated that there have never been enough people to enforce the rules.
Council Member Zittle would like the Special Use Permit to list exactly what Mr.
Giordano is able to do on the property. Council Member Kassel stated that the Planning
Board spoke to Mr. Giordano about that. It was agreed upon by all Members to add in
the Special Use Permit that there will be no wholesale or retail sales of any aggregate
product on the property. Council Member Krzemien asked if a Special Use Permit gets
renewed yearly-no it does not. Council Member Zittel was speaking to members of the
Planning Board, and two Members told him that they had not seen the map that Council
Member Zittel had in regards to the property. Town Clerk Safford informed him that the
Members that stated they did not see the map in question were not at the last Planning
Board meeting, which is when the Members were looking at that map. Council Member
Zittel asked if Mr. Giordano should move his sign to the section on the property that the
business is on if his permit is approved. Supervisor Drozd stated that the Board should
put some stipulations on the permit, but if neighbors are not complaining about the sign,
then we should leave it alone. The neighbor that is closest to Mr. Giordano’s property
spoke with Supervisor Drozd recently, and said he has no issues with what is being done
there. Council Member Zittel said that some neighbors are not happy but do not want to
cause problems so they are not saying anything on the record. Council Member Drake
said that since the County gave Mr. Giordano the permit to put the culvert in the road, the
Town should ask the County to add a stop sign at the property location. Supervisor
Drozd and Council Member Zittel do not feel that the county will do that since there are
not enough accidents there. Council Member Krzemien asked if the Town could request
that the County put up signs stating “trucks entrance”. Highway Supt. Heim stated that
according to his experience with the County, it is very difficult to get them to put any
signs up. Council Member Kassel spoke with Mr. Giordano the day before this meeting,
and Mr. Giordano was wondering if the court matter he has with the Town in regards to
the salt barn he added to the property has officially been cancelled, since he has not
received notification. Supervisor Drozd is going to speak to the court clerks on 2/19/26
to make sure that they send Mr. Giordano a notice officially stating that the court matter
is over. Council Member Zittel added that Mr. Giordano should pay commercial rates for
permits needed for his business if the Special Use Permit is approved, even though the
property isn’t zoned commercial, because he is running a business on the property.
Council Member Krzemien agreed with him, and stated that the Board should add that to
the Special Use Permit.
