WEST SENECA COURT ROOM DRAFT TOWN BOARD PROCEEDINGS 1250 Union Road Minutes - Meeting # 2026-05 West Seneca, NY 14224 March 9, 2026 NOW, THEREFORE, BE IT RESOLVED BY the West Seneca Town Board, that: 1. Supervisor Gary Dickson, or his representative or successor in office, is the representative authorized to act on behalf of the West Seneca Town Board in all matters related to State assistance under the New York State DOT and/or any applicable State grant provisions. 2. Supervisor Gary Dickson, or his representative, is also authorized to make application for 2026 New York State DOT Transportation Alternatives Program (TAP) funding in the amount of $1,725,709.00 (or 80% of the total project cost), submit Project documentation, and otherwise act on behalf of the West Seneca Town Board in all matters related to the Project and to State assistance; 3. The Town of West Seneca Town Board agrees to fund $431,427.00 of the $2,157,137.00 total Project cost, not to exceed 20%, by way of a General Obligation Bond or a series of Bond Anticipation Notes financed over a period of five or more years as well as a contribution from the Town’s capital reserves account, and that funds will be made available to initiate the Project efforts within 12 months of written approval of its application by the New York State DOT; 4. This Resolution takes effect immediately. On the question, Councilmember Breidenstein stated that while he supports moving forward with the process to pursue the TAP funding of 80%, he has significant concerns about the town taking on the responsibilities of the county for the other 20%. In his opinion, it is a dangerous precedent for the town to take on the obligations of the county roads. Councilmember Piekarec stated that he believes a provision in the state highway law places the pedestrian part of the county road on the municipality. While he agrees with Councilmember Breidenstein that the county should contribute, there have been complaints about the intersection for decades. Supervisor Dickson stated he intends to approach the county if the town is awarded the grant. Councilmember Breidenstein agreed that there are safety concerns about the intersection and the improvements would encompass more than the crosswalks and reiterated the need for greater support from Erie County Legislators.
