Town of Hamburg Planning Board Minutes May 6, 2026 all the way back as well. The only houses or residences are at the back of the property, well after where he is going to stop clearing. Member Ryan stated she would like to see a buffer on the Gullo’s side. The Board requested an aerial showing where the applicant wants to clear and existing photos showing the conditions of what the site looks like currently. Member Chmura stated that she will not support a building permit or a tree clearing permit without any additional trees being planted. It has been noted by CAB and by the applicant that the sole purpose of this is to clean up, not necessarily for future development. Member Clark asked if the Planning Board can mitigate the adverse impacts of a lawn. Mr. Rogers stated that the Planning Board has the authority to place conditions on approval for a clear-cutting permit. The project was tabled to the May 20, 2026 Planning Board meeting. Ten Lives Club Inc.- Requesting a use variance for the expansion of rescue services to be located at 3747 Lakeshore Road The attorney for the project did not appear but let Mr. Rogers know that should the project be tabled for a public hearing, she would appear. Mr. Rogers explained that the applicant did receive approval for a use variance from the Zoning Board during their May 5, 2026, meeting. The property is zoned M-3 and will be staying the same, however, the use variance now allows for the use of a rescue facility to be within the existing building located at 3747 Lakeshore Road. He further explained that it is before the Planning Board because they are the Board that does a change of use approval and site plan approval. Typically, for the use variance, if there is an existing survey or existing building layout that is what is used. The change of use approval is for it to go from a gentleman’s club to a rescue facility. The Zoning Board did not place any conditions on the use variance that was granted. Because this is site plan approval, the Planning Board does have the ability to place any conditions should they choose. The Planning Board has already issued a Negative Declaration for SEQR. Attorney Gogan clarified that there is a site plan application that indicates it is just for an animal rescue. The reason for this clarification is at the ZBA meeting there was discussion from the owner indicating that one of the possible uses would be a cat café. 13
