§ 280-450 Revocation. A. All short-term rentals, and those owning, occupying, managing and/or maintaining a short- term rental shall comply with all of the provisions of this section, the Town Code, all County, New York State and federal laws and regulations, and all orders, permits, notices, rules, regulations or determinations issued in connection therewith. B. The Code Enforcement Officer shall be granted access, upon reasonable request, at any time to ensure compliance with all applicable codes, rules, permits, regulations, safety provisions, and provisions of the Town Code. The Code Enforcement Officer may also request access to investigate any complaints received by the Town regarding the operation of the short-term rental. C. Should the Code Enforcement Officer find that the short-term rental or its owner, or agent is in violation of any applicable code, rule, regulation, permit, safety provision, law, or provision of this chapter, the Code Enforcement Officer may allow 10 business days for the violation to be cured. If the violation is not cured within the 10 business days, or no cure period was given, then the Code Enforcement Officer shall revoke the short-term rental permit. Upon revocation of the permit, the Code Enforcement Officer shall notify the short-term rental, its owner, or agent in writing of the revocation, including the reason for the revocation. Said notice shall be sent certified mail and via email to the addresses listed on the permit. Should the short-term rental, its owner, and/or agent wish to appeal the revocation, it may do so by filing a notice of appeal with the Town of Hamburg Zoning Board of Appeals within 60 calendar days of receipt of the notice of revocation. After the curing of a violation, an Applicant shall be required to follow sections 280-444. D. The Chief of Police or designee may recommend the revocation or the non-renewal of a short- term rental permit if he or she determines that a short-term rental compromises public health, safety, and/or welfare of the Town of Hamburg, and/or has become a nuisance to the neighborhood. A short-term rental may be considered a nuisance if it is the source of frequent calls for police service, an egregious criminal offense, and/or suspected criminal activity. The Chief of Police shall provide his or her recommendation to the Code Enforcement Officer in writing, including the reason(s) for revocation or non-renewal. The Code Enforcement Officer shall review the recommendation from the Chief of Police within 5 business days of receipt of the recommendation. Upon review of the recommendation, if the Code Enforcement Officer determines the short-term rental permit is to be revoked, the Code Enforcement Officer shall notify the short-term rental owner or agent of the revocation, including the reason(s) for the revocation. § 280-451.
