- ODZ (CHAPTER 95, SITE PLAN REVIEW) WHEREAS, the Town Board of the Town of Aurora (the “Town Board’) has proposed Local Law No. 4 -2026 to repeal and replace Chapter 95 “Site Plan Review” of the Town Code, originally adopted January 11, 1999; and WHEREAS, the proposed Local Law establishes updated site plan review regulations, including applicability and exceptions, review procedures, submission requirements, waiver provisions, and decision and filing procedures; and WHEREAS, the proposed Local Law includes a severability clause and takes effect upon filing with the New York State Secretary of State under Section 27 of the Municipal Home Rule Law; and WHEREAS, a public hearing was duly held on March 23, 2026, and the Town Board, acting as SEQRA Lead Agency, issued a Negative Declaration finding no significant adverse environmental impact; and WHEREAS, the Town Board has reviewed the proposed Local Law, public hearing comments, and all relevant materials; NOW, THEREFORE, BE IT RESOLVED, that the Town Board adopts Local Law No. + . 2026, the “Site Plan Review Code of the Town of Aurora, Erie County, and State of New York”; and be it further RESOLVED, that the existing Chapter 95 “Site Plan Review” is repealed and replaced as set forth in the Local Law; and be it further RESOLVED, that the Town Clerk is authorized to file the Local Law with the Secretary of State and take all actions necessary to effectuate this Resolution; and be it further RESOLVED, that this Resolution shall take effect immediately.
