This setback meets Town Zoning code section 116-8.4G(1) and now the request for area variance is not required. The applicant would like to proceed with the use variance portion of the application for the “In- Law Apartment”, which is currently accepted in the approved Town’s Comprehensive plan (as identified as an ADU) for all zoning districts, but not currently amended in the Town Zoning code.
