Village of Springville Local Law 12 of 2026 Local Law establishing a temporary Moratorium on Applications, Approvals, Permits and Construction retated to Data Centers and non-residential stand alone Battery Storage Units in the Village of Springvitte. The purpose of this Local Law is to establish a temporary moratorium on the acceptance, processing, review, consideration, approval, and issuance of applications, permits, certificates, site plan approvals, special use permits, variances, building permits, and other land use approvals relating to the construction, establishment, expansion, enlargement, conversion, or operation of Data Centers and non-residential stand alone Battery Storage Units within the Village of Springville. For purposes of this proposed Local Law, a “Data Center” shall mean a building, facility, or group of buildings and facilities used primarily for the housing, operation, management, processing storage, transmission, or distribution of digital data or electronic information through computer servers, network equipment, data storage systems, cooling equipment, backup power systems, and related infrastructure, including colocation facilities, cloud computing facilities, artificial inteltigence computing facilities, high-performance computing facilities, and similar commercial computing operations. For purposes of this Local Law, a “non-residential stand alone Battery Storage Unit” shall mean a building, facility, or group of building and facilities used primarily for housing all types of batteries, that store energy and can then be reintroduced back into the Village of Springville’s electrical system. The purpose of the moratorium is to allow the Village Board sufficient time to study the potential land use, zoning, environmental, infrastructure, public safety, utility demand, noise, traffic, and community character impacts associated with data centers and non-residential stand alone battery storage units and to determine whether amendments to the Village’s Zoning laws, Site Plan review laws and other applicable regulations are necessary to protect the health, safety, and welfare of the residents of the Village of Springville. The purposed moratorium would remain in effect for a period of one year from its effective date unless earlier modified, extended or repealed by the Village Board. This Local Law shall become effective immediately, as provided by law, upon filing with the New York State Secretary of State.
