I would ask the attorney whether this should be a resolution/policy or incorporated into the Village Code. I deliberately drafted this as a policy rather than pretending to know the proper legislative vehicle. New York's Department of State distinguishes local laws adopted by the legislative body from other municipal actions, so the attorney should determine the appropriate mechanism. D Department of State+1 2. I would have the attorney look particularly closely at Sections 4, 5, 16, 18, 25 and 30. Those are the places where the Village is exercising discretion over eligibility, public property, plaque content, donations and commemorations. 3. I intentionally changed the old draft's Tree Board role. Under the current Code, the Tree Board is an advisory body concerning trees; that makes it a very good technical reviewer, but I agree with you that it shouldn't be deciding whether someone's life warrants a public memorial.
