The Village may require a deposit sufficient to cover anticipated costs. 18. PAYMENT DOES NOT GUARANTEE APPROVAL Payment of any fee, donation or estimated cost shall not constitute approval of an application. No applicant shall acquire a right to a memorial, location, tree species, bench design, plaque wording or other Village property by virtue of payment. If an application is denied, the Village shall determine the disposition of any funds previously deposited in accordance with the applicable fee schedule and any agreement with the applicant. PART V — INSTALLATION AND MAINTENANCE 19. INSTALLATION All memorial trees and benches shall be installed by the Village or by a contractor authorized by the Village. Applicants shall not independently install, remove, modify, repair or relocate a memorial on Village property. The Village shall determine the timing of installation. Memorial trees shall generally be planted during periods considered appropriate for long- term tree survival and establishment, as determined by the Department of Public Works. 20. OWNERSHIP Upon installation on Village-owned property or within a Village right-of-way, the memorial tree, bench, plaque and associated improvements shall become and remain the property of the Village. The applicant shall acquire no ownership interest, easement, leasehold interest, maintenance right or other property interest in the memorial or the location. 21. TREE MAINTENANCE
