Memorial trees shall be maintained by the Village in substantially the same manner as
other Village trees, subject to available resources and the Village's ordinary maintenance
practices.

The Village shall not guarantee the survival of any memorial tree.

Memorial trees may be pruned, treated, relocated, removed or replaced as determined
necessary for public safety, tree health, utility work, construction, infrastructure work,
maintenance or other legitimate Village purposes.

22. INITIAL TREE ESTABLISHMENT

The Village shall make reasonable efforts to establish newly planted memorial trees in
accordance with its ordinary tree-planting practices.

Where appropriate, newly planted trees may receive staking, watering and other
establishment measures consistent with Village practices.

The Village shall not be responsible for providing a level of care beyond that ordinarily
provided to comparable Village trees.

23. TREE FAILURE AND REPLACEMENT

If a memorial tree dies or fails within the first two years following installation, the Village
shall evaluate the condition of the tree and may replace it in accordance with its ordinary
tree-replacement practices.

The Village may select a different species, size or location where the original selection or
location is determined to be unsuitable.

After two years, the Village shall have no obligation to replace a memorial tree that dies,
becomes diseased, is damaged, or is removed for any reason.

Nothing in this section shall limit the Village's authority to replace a tree at any time when
the Village determines that replacement is appropriate.
