VILLAGE OF EAST AURORA COMMEMORATIVE MEMORIAL TREE AND BENCH PROGRAM PROPOSED POLICY — DRAFT FOR ATTORNEY AND CLERK REVIEW Proposed Adoption: [DATE] Approved By: Village Board of Trustees Effective Date: [DATE] 1. PURPOSE AND INTENT The Village of East Aurora recognizes that individuals, organizations, events and contributions may have played a meaningful role in the civic, cultural, historical, social or community life of the Village and that, in appropriate circumstances, a public memorial may provide a lasting and meaningful way to recognize such contributions. The purpose of this policy is to establish a consistent, equitable and transparent process by which the Village may consider requests for commemorative memorial trees and benches on Village-owned property or within Village rights-of-way. The Village intends this program to provide for public commemoration of persons, organizations, events and contributions having a substantial and meaningful connection to the Village, rather than to establish a program through which private individuals may purchase or reserve memorial space on public property. The Village Board recognizes that a meaningful connection to the Village is not necessarily limited to legal residency. A person who did not reside in the Village may, under appropriate circumstances, have had a substantial and longstanding presence in, relationship with, or contribution to the Village community. At the same time, a person's general appreciation of the Village, occasional visitation, or personal preference for the Village, without more, shall not ordinarily constitute a sufficient basis for a commemorative memorial on Village property. 2. POLICY AUTHORITY This policy shall govern the Village's consideration of requests for commemorative memorial trees and benches and shall be administered consistently with the East Aurora Village Code, including Chapter 240, Trees, and any other applicable law, ordinance, rule or regulation.
