2. Town Attorney re Local Law 2026-4 Modification of Chapter 46-6 Avoidable Alarms

Councilmember Piekarec stated that he joined the Fire Chiefs, Fire Commissioners, and Police
Department Liaison Captain Unger to review the town code, noting it has been approximately 30
years since the provision had been updated. The fire departments feel that the code is not punitive
enough for locations that have repeated false alarms.

Motion by Supervisor Dickson, seconded by Councilmember Piekarec, to schedule a public hearing
for Local Law 2026-4 Modification of Chapter 46-6 Avoidable Alarms.

On the question, Councilmember Breidenstein requested information regarding the nature of the
calls. In his opinion, Councilmember Breidenstein feels there are ambiguities and inconsistencies in
the policy with regard to the time the residents and businesses may be penalized; his concern is that
the focus is being overly punitive and mentioned senior citizens that rely on alarm systems for
medical issues.

Councilmember Sherman asked how the penalty amounts and occurrences were established.
Councilmember Piekarec stated Mr. Trapp made the changes. Mr. Trapp stated the number of
occurrences did not change much; the amounts can be adjusted according to the Town Board's
discretion. Councilmember Sherman asked if the revised code would also follow the calendar year.
Councilmember Piekarec stated 2 years for Police alarms. Supervisor Dickson stated the purpose of
the motion is to schedule a public hearing.
