WHEREAS, the Town has determined it will need a dedicated sole source of funding to continue to
construct, operate, and maintain sufficient stormwater infrastructure to comply with increasingly

address the effects of increasing precipitation as a result of climate change; and

WHEREAS, the Town Board of the Town, pursuant to Article 12-a of the New York Town Law,
desires to create a Town-wide Drainage and Stormwater Management District (the "District") to

support the potential formation of, the proposed District (“Report”), in such detail as required by
Section 209-c of the Town Law; and

WHEREAS, the Town Board previously adopted a Resolution, dated August 10, 2026, calling for a
public hearing on the establishment of the District; and

WHEREAS, the Town Engineer has subsequently prepared and delivered to the Town Board an

and complies with the requirements of Section 209-c of the Town Law; and

WHEREAS, the formation of the District requires the Town to comply with the New York State
Environmental Quality Review Act (Article 8 of the Environmental Conservation Law and its
implementing regulations at 6 NYCRR Part 617) and the Town’s Local Waterfront Revitalization
