Information submitted: FEAF Part 1, Safety Systems and Regulatory Controls at Modern Fueling
  Facilities Memo

Conclusion: The project is not anticipated to have a significant impact on the noise, odor, or light
  on the site.

16. Impact on Human Health

Given that part of the project involves a fuel station component, there have been some questions
in regard to applicable safety standards for fueling facilities. The Applicant presented at the 3/9
Town Board public hearing and produced a memo detailing the applicable EPA and NYSDEC
standards. Fueling facilities in New York State operate under strict environmental regulations
requiring advanced engineering systems and operational safeguards. These protections—
including double‑wall tanks, leak detection technology, spill containment systems, operator
training, and regular inspections—greatly reduce the risk of fuel releases compared to older filling
  station designs.

Conclusion: The project is not anticipated to have a significant impact on human health.

17. Impact on Community Plans

Due to the project needing a rezoning, the question of whether “the proposed action is
inconsistent with local land use plans or zoning regulations” was checked as a moderate to large
  impact.

During Code Review and Planning Board review of the project, it was determined that a rezoning
from C-1 to C-2 would not result in spot zoning, nor would it be inconsistent with zoning in the
area, given that there are C-2 uses across the street, and to the immediate east of the property.
The project is within a commercial corridor of the Town, and the rezoning report that was
produced by the Planning Board highlights that Comprehensive Plan denotes that the north side
of Southwestern Boulevard is a commercial area but suggests that it needs uses and restrictions
that protect the surrounding residential areas.

There also is adequate fire protection and other community services in this area.
