• The vendor shall also secure and maintain the following insurance: See insurance document attached. All coverages are to be written in a company licensed in New York and the company should have a Best’s Key rating Guide rating of at least B+. • A certificate of the above required insurance providing a minimum of 30 days written notice of cancellation or non-renewal of such insurance shall be submitted to the Town Attorney's office, Town Hall, 6100 South Park Avenue, Hamburg, New York 14075, prior to execution of the installation (see accompanying Certificate of Insurance sample for reference). • Indemnification: Vendor agrees that it shall, to the fullest extent permitted by law, defend, hold harmless and indemnify including the payment of attorney’s fees and costs, the Town of Hamburg and any other facility owner, and their respective agents, officers, and employees, from and against all claims, suits, damages, defense, and other legal costs and expenses of any kind, arising out of, resulting from, caused by, or in any way related to the activities and operations of Vendor and/ or use of Town owned or provided facilities. • The town's insurance requirements are subject to change at the sole discretion of the Town and its insurance consultants. • The Town will NOT provide any use of Town owned equipment for any portion of the project. • THE TOWN RESERVES THE RIGHT TO REJECT ALL PROPOSALS, to consider the reputation of the applicant in making its selection, and to waive any informalities or minor deviations from the specifications. • This sheet must be signed and returned with the proposal. ___________________________________ Signature of Applicant 42
