Hamburg Town Board
Part 3 Analysis
Briad Development Southwestern and Big Tree Rezoning
0 Big Tree Road and Southwestern Boulevard, Hamburg, NY 14219 (SBL#: 160.18-1-9.1)
4/13/2026

Based on Part 1 and Part 2 of the FEAF, information submitted by the Applicant, correspondence
received, and discussions of the Planning Board and Town Board, the following potentially moderate
to large impacts were identified, and have been analyzed:

Project Description and Action
See FEAF.

1. Impact on Land
The project will disturb approximately 2.2 acres of land out of a 4.08-acre site, with conversion to
a convenience store building, a gas station facility, with drive-thru space, 43 parking spaces, and
other impervious areas. Approximately 1.5 acres of land will consist of impervious surface. Final
engineered plans will be reviewed and approved by the Town Engineer, including a Stormwater
Pollution Prevention Plan (SWPPP). Appropriate erosion and sediment control measures will be
required during construction, with inspections occurring by a qualified person. A condition of the
rezoning approval will be to maintain existing natural features, and vegetative buffers on the site,
especially to keep a 0.66-acre lawned area on the site and to buffer the nearest adjoining
neighbors at Big Tree Road and Burke Parkway, to be addressed during site plan review.

A landscaping plan will need to be prepared that focuses on highlighting the existing natural
areas to be maintained in addition to the substantial tree planting that will take place around the
Project Site and especially in screening areas easily meeting § 280-209’s requirement for a
single tree to be planted every 30 feet. This landscape plan can also be a rezoning condition that
is subject to Planning Board review/approval during the site plan stage.

Information submitted and Analysis: Proposed Site Plan, FEAF Part 1, Planning Board Rezoning
  Report.

Conclusion: The project is not anticipated to have a significant impact on land.

13. Impact on Transportation
The site is bounded by Big Tree Road to the north, Interstate 90 to the west, Southwestern
Boulevard to the south, and where the Seven Corners intersection was removed to the east. The
project site is currently vacant land. Land uses within the vicinity of the project site are generally
commercial. The proposed development consists of a multi-tenant commercial site designed to
