The following section shall be removed and replaced:
§ 144-57
A. Abandonment of Use In any district, whenever a nonconforming use of land, premises, building or
structure or any part or portion thereof has been discontinued for a period of one year, such
nonconforming use shall not thereafter be reestablished, and all future use shall be in conformity with
the provisions of this chapter. Such discontinuance of the active and continuous operation of such
nonconforming use or a part or portion thereof for such period of one year is hereby construed and
considered to be an abandonment of such nonconforming use, regardless of any reservation of an intent
not to abandon same or an intent to resume active operations. If actual abandonment in fact is evidenced
by the removal of buildings, structures, machinery, equipment and other evidences of such
nonconforming use of the land and premises, the abandonment shall be construed and considered to be
completed within a period of less than one year and all rights to establish or continue such
  nonconforming use shall thereupon terminate.

B. Vacant Buildings (see §144-5 Terms Defined)
  1. Applicability
  a. This Local Law applies to all buildings within the Town of Orchard Park, excluding buildings
located within the incorporated Town of Orchard Park to the extent that they are already subject to
similar Town regulations such as the Town’s Vacant Building Registry or related chapters.
  b. Where a building is subject to overlapping regulations by the Town and another jurisdiction, the
more restrictive or protective provisions shall govern, to the extent permitted by law.

  2. Vacant Building Registration Required
  a. Registration obligation.
The owner of any building that becomes a vacant building, as defined herein, shall register the
building with the Town Code Enforcement Officer within 30 days of the building becoming vacant
or within 30 days of notification by the Town that the building appears to be vacant, whichever is
  sooner.

  b. Registration form.
The registration shall be on a form provided by the Town and shall include:

o The owner’s name, mailing address, telephone number, and email.

o If the owner is not a natural person, the name, address, and contact information of a local
individual authorized to accept service and act on behalf of the owner.

o The street address and tax map parcel number of the property.

o The date the building became vacant or is expected to become vacant.

o Whether utilities are on or off.

  o A plan for:

  ▪ Maintaining the property in accordance with this Local Law and all applicable codes.

  ▪ Securing the building.
