10th Town Board Meeting 05/20/2026 Page 2 WHEREAS, a two-year maintenance bond, in the amount of $178,161.00, has been submitted along with the Affidavit of Release of Liens, Affidavit of Subcontractor Payment, and necessary legal documents. NOW, THEREFORE be it RESOLVED, that the Town Board does hereby approve the final change order and authorize release of the retention for the Community Activity Center Generator Installation Project, (General Contract) to Greenauer Blacktop Inc., 391 French Road, West Seneca, New York 14224, in the amount of $8,908.05; and be it further RESOLVED, that the Town Board does hereby authorize the Town Clerk to release Greenauer Blacktop Inc. performance security in the amount of $157,300.00 as recommended by the Town Engineer. The resolution was unanimously adopted. Old Business # 2 Approve the final change order/final payment and authorize release of retention for the Orchard Park Little League, 90ft Baseball Diamond – Earth Work, Thorn Ave. /Duerr Road Facility Project to Greenauer Blacktop Inc in the amount of $24,647.40. 3) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMEMBER HONER, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMEMBER MOMBREA, TO WIT: WHEREAS, construction work for the earthwork construction contract, on the Orchard Park Little League, 90' Baseball Diamond Project, has been completed. On October 4, 2024, a final inspection was conducted, and all Final Punch List work has since been satisfactorily completed in accordance with the contract documents and specifications; and WHEREAS, a two-year maintenance bond, in the amount of $492,948.00, has been submitted along with the Affidavit of Release of Liens, Affidavit of Subcontractor Payment, and necessary legal documents. NOW, THEREFORE be it RESOLVED, that the Town Board does hereby approve the final change order and authorize release of the retention for the Orchard Park Little League, 90' Baseball Diamond Project, Thorn Ave. / Duerr Road Facility (Earthwork Contract) to Greenauer Blacktop Inc., 391 French Road, West Seneca, New York 14224, in the amount of $24,647.40; and be it further RESOLVED, that the Town Board does hereby authorize the Town Clerk to release Greenauer Blacktop Inc. performance security in the amount of $489,000.00 as recommended by the Town Engineer. The resolution was unanimously adopted. Old Business #3 Approve the final change order/final payment and authorize release of retention for the Berg Road Sanitary Sewer Pump Station Project – Electrical Contract to Stenzel Electric Construction Inc in the amount of $21,307.20. 4) THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMEMBER MOMBREA, WHO MOVED ITS ADOPTION, SECONDED BY COUNCILMEMBER BENNETT, TO WIT: WHEREAS, the construction work on the Berg Road Pump Station Replacement Project — Electrical Contract has been completed. On November 19, 2025, a final inspection was conducted, and all of the work has since been satisfactorily completed in accordance with the contract documents and specifications; and
