ECSD No. j Board o/ Managers
  December 3,2025 Meeting Minutes

The new effluent pumping station and chlorine contact tank have been operational for
three (3) months. During the last Board meeting the Division of Sewerage Management (DSM)
discussed the formation of algae in the new chlorine contact tank. While algae has not been an
issue with the change in weather, there have been problems with certain State Pollutant
Discharge Elimination System (SPDES) permit compliance samples that have led to adjustments
by operations staff to address. Otherwise, everything appears to be functioning well.

Phase 2 construction continues to be on hold until the new SPDES permit is in
place. The updated goal has been to bid Phase 2 work in the first quarter of 2026, however, the
DSM has yet to receive the draft permit from the New York State Department of Environmental
Conservation (NIYSDEC). The last update from the NYSDEC was the draft permit was sent to
their Division of Environmental Permits on October 3 I 't, which usually takes another week or
two before a permit is published. It is uncertain why there has been another delay.

As noted during the last Board meeting, Arcadis, the project consultant, has analyzed
their remaining work to be completed based on the latest construction schedule and the
additional services they have provided. This information was reviewed and there has been back-
and-forth on various questions/comments. Ultimately an amendment to Arcadis's engineering
agreement would be issued along with award tbr the Phase 2 contractor. Finally, there are no
updates on the $10 million grant request through the NYSDEC's Water Quality Improvement
Project program or the $25 million grant request through the New York State Environmental
Facility Corporation's Water Infrastructure Improvement Act program.

  b. Steuben Foods / Mooe

In July 2025 the DSM submitted a FAST-NY Track "B" grant application to Empire
State Development for the Elma Pumping Station and Force Main Upgrades project. In October
2025 Empire State Development requested, and were subsequently sent, additional infbrmation
to support their review of the application. While awaiting word on the potential grant, the DSM,
Steuben Foods, and Moog have completed a memorandum of agreement for the Track "B"
project should the grant be awarded, including the cost share by both industries. The DSM has
also completed a draft request for proposals for the Elma Pumping Station and Force Main
Upgrades engineering work. With these items drafted, the hope is to decrease the lead time
before actual work may commence should a grant award be issued.
