The Village Administrator may determine that an application is substantially similar to a previously denied application and may decline to forward such application to the Village Board. Nothing in this section shall prevent the Village Board from reconsidering a prior decision on its own initiative. A subsequent application shall not be used to circumvent a prior Village Board determination by changing the identity of the applicant while leaving the subject and substance of the request substantially unchanged. 36. VILLAGE DISCRETION Nothing in this policy shall be construed to require the Village to approve a commemorative memorial. The Village Board retains discretion to determine whether a proposed memorial is consistent with the public interest, the character of the Village, the purposes of this program and the appropriate use of Village property. The Village may establish additional reasonable conditions as part of any approval. 37. SEVERABILITY If any provision of this policy is determined to be invalid or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions. 38. REVIEW OF POLICY The Village Board may periodically review this policy and may amend, suspend or terminate the commemorative memorial program at any time, subject to applicable law.
