HAMBURG SIA DISTRICT ZONING  15

  D. Interim Property Maintenance and Development Obligations
  1) Applicability. The requirements of this subsection shall apply to all land, buildings,
  structures, and development parcels within the SIA District, including land that has been
  subdivided following approval of the master development plan.
  2) Continuing Responsibility. The owner of record of each parcel shall be responsible for
  compliance with the requirements of this subsection including any new and/or additional
  owners resulting from any subdivision of a parcel.
  3) Maintenance of Undeveloped Property. Any portion of the SIA District not actively under
  construction shall be maintained in a safe, orderly, and attractive condition. Such areas shall
  be kept free of debris, refuse, abandoned equipment, disabled vehicles, construction waste,
  hazardous conditions, and excessive overgrowth.
  4) Maintenance of Vacant Development Parcels. Vacant parcels intended for future
  development shall be graded, stabilized, and maintained to prevent erosion, nuisance
  conditions, and deterioration of the appearance of the District. Temporary seeding,
  landscaping, fencing, stormwater facilities, and other site improvements shall be maintained
  in good condition until development occurs.
  5) Demolition and Site Restoration. Following demolition of any principal structure, the
  property owner shall restore the site within six months of completion of demolition unless
  redevelopment construction has commenced. Site restoration shall include, at a minimum:
  a) Removal of foundations, debris, and construction materials, unless specifically
  approved to remain as part of a future development phase;
  b)  Grading and stabilization of disturbed areas;
  c) Seeding, landscaping, or other ground treatment sufficient to prevent erosion and
  maintain an orderly appearance;
  d) Installation and maintenance of any fencing or screening required by the Town Board.
  6) Vacant Buildings. Any building that becomes vacant shall be maintained in a weather-tight,
  secure, and code-compliant condition. Broken windows, damaged doors, deteriorated
  exterior materials, graffiti, and similar conditions shall be repaired in a timely manner.
  7) Interim Site Management Plan. As part of the Special Use Permit approval, the applicant
  shall submit an Interim Site Management Plan identifying the party responsible for
  maintenance of undeveloped lands, vacant development parcels, stormwater facilities,
  landscaping, temporary improvements, and common areas. The Plan may be amended from
  time to time as parcels are subdivided or ownership changes.
